Cold Weather Safety Tips

Cold Weather Safety Tips

We are going to see lower temperatures across the province in January 2016.  We will have the usual extreme cold weather alerts, inordinate amounts of snow, freezing rain and of course icy sidewalks.

The elements can be harsh and dangerous whether you are a pedestrian or motorist. In Windsor and Sarnia, our winters are harsh and often unbearable and can in many cases have consequences for both the inside of the home’s plumbing as well as the outside; contacting Plumber Wave can help eliminate many of the issues that may arise in terms to damages and potential accidents. Winter weather is particularly dangerous for pedestrians, with exposure to wind-chill and risk of hypothermia, frostbite and personal injuries such as slip and fall accidents. The Canadian Red Cross recommends always keep your head covered and wearing fabrics that are insulated, like wool. Always keep exposed areas covered including your face, ears and fingers.

It is important to always wear a hat and keep your head covered because half your body heat can escape through an uncovered head. Mittens or Gloves? Believe it or not, mittens are recommended as more warmth is created when our fingers are kept together. Slip and fall accidents are also prevalent in the winter months due to compacted snow, freezing rain, build ups of ice and slush. Slip and fall accidents can cause serious injuries ranging from broken bones to traumatic brain injuries.

Here are some tips in order to prevent slip and fall accidents:

  1. Keep a supply of salt in your garage (or near your front door): Make sure you can easily access salt to salt your walkway,driveway, and sidewalk in front of your house to make it safe for yourself, your family and any potential visitors;
  2. Make sure your driveway and walkway are well lit: If you do not have outdoor light fixtures, you may want to consider installing them so you have a clear view of your walkway and driveway.
  3. Invest in proper footwear: We recommend that proper footwear be worn at all times- buy winter boots with non-skid soles (and buy lined boots to keep your feet warm);
  4. See and Be Seen: The snow can cast a bright reflection- make sure you can see your surroundings when you are walking and keep a pair of sunglasses with you to protect your eyes from the sun’s glare. Wear something bright or reflective so that drivers can see you.
  5. Listen: You may be wearing a hood, or have a hat on, but even with your ears covered, you should still be aware of approaching vehicles or people. Always be aware of your surroundings, so you do not have to make any sudden moves which could cause you to fall;
  6. Use handrails where available: When you reach a set of stairs, always use the handrail where one is available to help you with your balance and pace yourself. Do not rush up and down stairwells as they are dangerous and an accumulation of precipitation on a set of stairs can lead to a serious injury;
  7. Beware of Ice: After rain, or where snow has melted, be wary of what looks like wet pavement as it could actually be what is known as black ice, which is dangerous to walk on;
  8. Enter slowly: Take extra caution when you enter your destination, be it your workplace, a shopping centre or school as the floor may be wet due to an accumulation of melted snow and ice;
  9. Avoid shortcuts: Only take well-lit, well-travelled routes and avoid areas that may not have been salted and may be dark;

10. Practice “conscious walking”: Be conscious of where you will place your feet and anticipate your next steps, look up so that you are aware of the surface ahead and scan your surroundings to ensure you are not in the way of oncoming vehicular or pedestrian traffic.

Why It’s Important To Talk About Brain Injuries

Why It’s Important To Talk About Brain Injuries

Public awareness about traumatic brain injuries is on the rise. Stories about traumatic brain injuries are prominent in the news. It is not just the public’s understanding of brain injuries but doctors’ understanding of traumatic brain injuries has increased.

First it is important to make a distinction between head injury and brain injury.

A head injury is an injury to the skull. A brain injury can be the result of a head injury. A brain injury causes changes to how the brain functions. The World Health Organization defines acquired brain injuries (ABI), a type of brain injury that is not present at birth. A type of ABI is a traumatic brain injury (TBI) which is a brain injury that occurs as a result of external force.

One exciting development in traumatic brain research is the development of a biomarker that will be able to identify whether someone has sustained a concussion through a blood test. This would be a dramatic departure from the subjective way concussions are currently diagnosed.

A new company called Quantum Institute has developed a mobile brain scan for concussions, with their first product being a brain mapping system, similar to an electroencephalography. An EEG detects electrical activity in the brain and the machine developed by Quantum Institute uses quantitative EEG and computer analysis to determine the precise location of the wave patterns of the scan. This technology has potential to detect a subtle injury like a concussion as typically imaging such as MRIs can detect only more serious brain injuries.

Doctors who have an interest on lowering the risk of sports concussions and long-term head injuries have introduced a technology called Hit-Count. The technology with which Hit Count will use to certify products will be tested using protocol developed by the University of Ottawa’s Neurotruama Impact Laboratory in combination with engineers from partner companies.  Hit Count is a data-driven personal analysis platform backed by Dr. Chris Nowinski of the Sports Legacy Institute, a non-profit organization who partners with other organizations to measure brain trauma in real time using helmets, headbands and mouthguards. Hit Count was designed to establish guidelines to help parents and coaches regulate the “allowance” of brain trauma in children.

New research from a study published in the journal, Pediatrics in January 2014 shows that giving the brain a “rest” after suffering a concussion is actually beneficial. A lack of data with respect to cognitive rest previously led to contradictory advice from medical professionals and varying recommendations for treatment. The general public and those providing care for people with concussions fail to appreciate the strain that cognitive effort puts on the injured brain. The study showed that vigorous cognitive exertion prolongs recovery time.

What Type Of Injuries Can Occur As The Result Of A Car Accident?

What Type Of Injuries Can Occur As The Result Of A Car Accident?

A motor vehicle accident can cause different types of injuries. A motor vehicle accident can cause both physical and psychological injuries.

This blog post will look at some common injuries that occur as a result of motor vehicle accidents.

  • Whiplash – because of the force of the impact of a collision, whiplash is a common injury. The head and neck are propelled forward or backward, causing neck strain. Whiplash injuries include pain, stiffness and in some cases dizziness and numbness which can spread to other areas.
  • Spinal cord injuries- serious accidents can cause spinal cord injury, were a person can experience herniated disc, severed cord or damaged vertebrae. Serious injuries such as paralysis can occur as a result of car accidents.
  • Traumatic brain injuries/head trauma can occur as the result of the head being jolted during a collision. A person may experience a mild traumatic brain injury such as a concussion, or more serious injuries can occur if the head hits the steering wheel.
  • Chest injury – the seatbelt can cause injury to the ribcage and chest. In some cases, the force of the seatbelt, or airbag can break the rib cage or damage a person’s lungs.
  • Back injury – many clients report low back pain as a result of car accidents, whether it is from degenerative disc disease, a herniated disc or the force of the impact causing a spinal cord injury.
  • Foot and Leg injury – lower extremity injuries do occur as the result of car accidents. For example, a driver may strike his or her knee on the dashboard as a result of the collision, or the instrument panel. The feet and legs absorb the impact so these areas are susceptible to injuries.

If you or someone you know has been injured as the result of motor vehicle accident, we encourage you to contact the experienced Windsor personal injury lawyers at Paciocco & Mellow at (519) 915-SORE (7673).

Why You Need an Experienced Personal Injury Lawyer

Why You Need an Experienced Personal Injury Lawyer

After a car accident, slip and fall accident or any other type of serious personal injury, you want to hire a lawyer that is right for you and your family.

You want to hire someone who will be attentive, understanding and who will treat you with respect and like a person (and not just a file number). You want to feel that you can call your lawyer and ask him or her any question, without feeling embarrassed or fearing judgment.

Before the era of the Internet and social media, the common way to find a lawyer was word of mouth. Referrals from previous clients (family members, friends, co-workers) are positive proof that a firm provides excellent client service and results.

Gino and Jeff Image

Today, many people rely on Google searches when choosing a personal injury lawyer, and they gravitate towards the advertisements at the very top of the page or the side of the page. These are often paid advertisements, and are not indicative of a firm’s popularity or experience.

The best way to learn about a firm or a particular lawyer or firm is to read about them through reviews on the internet, and to visit their website, look to see how much experience the firm/the lawyer has in personal injury law, and what areas of law the firm/lawyer practices in.

A firm that practices in too many distinct areas of law, for example personal injury law, family law and estate law may not be the right firm for you. If you want a firm that takes your best interests into account, you will want a firm with experience and that focuses on personal injury law. A firm who solely practices personal injury law will be able to get you the best settlement and the most amount of compensation.

Something else to consider is, do you want a firm that represents both injured persons and insurance companies? Some personal injury firms also practice insurance defense. At Paciocco & Mellow, we only represent injured persons, as we believe that there is an inherent conflict of interest if a firm represents both sides.

Our lawyers have a unique perspective to offer clients. Prior to founding Paciocco & Mellow, Gino Paciocco and Jeffrey Mellow represented insurance companies in personal injury lawsuits. As a result, they have gained perspective on how insurance companies and their lawyers think and act when it comes to the different steps of a lawsuit and settlement. The lawyers at our firm can therefore provide their clients with realistic expectations about their lawsuit.

The law firm of Paciocco & Mellow prides itself on its reputation of excellent service and client satisfaction.

We understand how client may feel overwhelmed during the legal process and we strive to provide the best service possible and to help our clients in any way that we can, be it a referral to a specialist, rehabilitation provider, help securing a litigation loan or providing reassurance.

If the accident was my fault, do I still have a claim?

If the accident was my fault, do I still have a claim?

Even if you were charged by the police as a result of your car accident or feel that the accident was your fault, you may still have an accident claim. It is often the case that there is more than one cause for an accident or person at fault for an accident. In addition to your own actions, the actions of another person may have contributed to the cause of the accident. It is important that you speak with one of the experienced lawyers at Paciocco & Mellow as soon as possible following your accident so that the potential responsible parties can be identified.

If it is determined by our experienced lawyers that the accident was your fault, you may still have a claim against an insurance company for some compensation. If you were involved in an automobile accident, you may have access to Statutory Accident Benefits which can provide compensation for such things as lost income and medical expenses. You may also have access to a disability insurance policy to compensate you in the event of disability.

A Concussion is a type of Brain Injury

Previously, we discussed the effects of mild traumatic brain injuries and how a recent study found they can effect cognitive functioning.

Any type of brain injury can have a long-lasting impact on the person who has sustained the injury and his or her family.

Concussions are a type of brain injury. People used to think that a “bump on the head” wasn’t dangerous and concussions didn’t require medical attention. Thanks to all the media attention over the past few years, the general public is more aware about the effects of brain injuries.

The Centre for Disease Control and Prevention has referred to traumatic brain injuries as a silent epidemic.

For example, the impact of a concussion can mean difficulties with school, work, sports because of memory difficulties, balance issues, fatigue or headaches. If symptoms last longer than 3 months, a diagnosis of post-concussion syndrome can be made.

It is possible to recover from a mild traumatic brain injury but there are people who may not recover because their injuries have not been realized as their symptoms did not become apparent right away. Someone who suffered a brain injury as a result of a car accident or slip and fall accident might not realize the extent of his or her injuries until resuming employment or regular habits.

Why does this occur? Unfortunately, it is not always possible to detect signs of a concussion or mild traumatic brain injury on a CT scan. However, this does not mean that one has not occurred.

It is also important to note that once someone has suffered one concussion, if a second concussion occurs before the person has recovered from the first, the greater the injuries will be. The injuries will be compounded as a result of the person not having the chance to heal properly. This is known as “second impact syndrome”.

If you or someone you know has sustained a traumatic brain injury as a result of a car accident, slip and fall accident or any other type of person injury, do not hesitate to contact an experienced person injury lawyer right away.

At the law firm of Paciocco & Mellow, we have represented many clients who have sustained serious injuries as a result of car accidents, slip and fall accidents, pedestrian accidents, bicycle accidents and other types of personal injuries. We can help clients who have sustained traumatic brain injuries and other serious injuries with finding the right rehabilitation clinics and help them with their recovery.

How Long Will It Take For My Claim To Resolve?

Every case is different and, as noted above, there are many factors that affect your claim. Most cases take two to three years to resolve, however, some are resolved in less time and some take much longer. You should keep in mind that while you may what to put your accident behind you as soon as possible, a quick settlement may not be in your best interest. It often takes time to see what your condition in the long-term will be and it is important for you to have a good idea about what the future holds before entering into a settlement.

The experienced lawyers at Paciocco & Mellow will work hard to make sure that you get the compensation you deserve in the shortest amount of time possible.

What’s Sleep Got to Do With It?

A new study from the University of Warwick found that chronic pain suffers were able to increase their levels of physical activity by improving the quality of their sleep.

The study authors found that engaging in physical activity is a necessary component to pain management.

The study showed that chronic pain patients were able to spontaneously engage in physical activity after sleeping well. The study showed that sleep helps pain-related insomnia and provided a means to keep chronic pain patients active. By helping chronic pain sufferers with pain-related insomnia and to become more active, the study has found methods to improve quality of life for chronic pain patients.

According to the study results, sleep was found to be the determining factor when it came to a person’s ability to participate in physical activity, as sleep has a naturally recuperative power, which is often overlooked in pain management.

Sleep quality was seen to be a “key driver” of physical activity over low mood and pain.

Chronic pain is pain that persists for more than 3 to 6 months. Many people develop chronic pain as a result of being involved in a car accident or slip and fall accident.  The law firm of Paciocco & Mellow has handled many cases for clients with chronic pain. If you have developed chronic pain, it is important to obtain proper treatment. If you have been injured as a result of a car accident, you can access treatment through Statutory Accident Benefits. If your benefits have been denied, our law firm will advocate for our rights and help you get the treatment you need.

Traumatic Brain Injuries Headline the News

Football is back in season and the concussion/traumatic brain injury crisis still remains a growing concern for the NFL, its lawyers and players.

An article from the Globe and Mail reveals that according to an actuarial study, 1 in 4 football players will end up with some form of “brain problems” in their lifetime, which can include dementia, Alzheimer’s, Parkinsons or other cognitive impairments. The study used a database of retired football players. The report was released by the NFL’s lawyers, as part of their position on the potential dangers of football.

The report stated that 28% of the overall population and one third of the 5000 football players that are suing the NFL will be diagnosed with cognitive impairment during their lifetime.  The chances of developing these problems were noted to be “materially higher than the general population”, and they would develop at a younger age than would be expected.

Would You Consider Usage Based Insurance?

Insurance companies are always in competition with each other when it comes to offering the best rates. In recent times, insurance companies like Desjardins and The Co-operators have been offering usage based insurance programs to help drivers reduce their insurance premiums.

The idea is that the insurance company is in essence, sent data about how you drive. Factors like your average speed, how you stop, reaction time, are taken into consideration and if you are “good driver”, you can receive a discount on your insurance.

More and more people are willing to consider usage based insurance, according to a recent survey conducted by Towers Watson & Co., which revealed that almost 80% of drivers are open to purchasing a usage based policy, especially if insurers guarantee their rates are not going to increase.

However, nearly half of consumers are still hesitant about the risk of potential higher premiums that could result from usage-based insurance. Another concern is over privacy. Survey respondents indicated concerns that their insurance companies would be receiving data that would allow them to monitor their driving destinations, but there seemed to be a decline in the number of people that are concerned with privacy concerns compared to the past year and a half.

Another survey, conducted by LexisNexis Risk Solutions revealed that 68% of consumers worried about their insurance companies obtaining too much information. This percentage is less compared to 2013. As consumers are becoming more familiar with what usage based insurance is, they are more likely to perceive it as useful and relevant.

As a drivers, should we be concerned with insurance companies using this data against us? Can this data possibly be used to explain how a car accident happened or to track what speed we were driving when an accident occurred? How specific is the data that is recorded? Would this data be admissible as evidence, or be used to prove liability in personal injury cases? These are some questions that people might be asking themselves. For now, what we know is that usage based insurance is meant to offer drivers discounts for driving well.

If you or someone you know is a victim of a car accident and has sustained any type of injuries, you should consider contacting an experienced personal injury lawyer right away.
